2. The petitioner seeks regular bail in connection with Chhatapur P.S. Case No. 236 of 2024, dated 22-07-2024, registered for offences punishable under Sections 137(2),87 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. The prosecution case, in short, is that on 19.07.2024 at about 3:00 P.M., the informant's minor daughter went outside her house to attend the call of nature. It is alleged that in the meantime, 11 FIR-named accused persons, including the petitioner, abducted her by pressing her mouth to prevent her from raising an alarm. Although the villagers conducted a
Patna High Court CR. MISC. No.52542 of 2025(2) dt.12-08-2025 2/3 search, no cogent information could be found about her whereabouts; as such, there was strong apprehension that the accused persons might have subjected her to honor killing.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. It is further submitted that there was a love affair between the petitioner and the daughter of the informant. It is further submitted that the statement of the victim was recorded under Section 183 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), wherein she clearly stated that she and the petitioner were in a consensual relationship and she went with the petitioner on her own sweet will. It is also submitted that the victim has categorically stated that nothing wrong was committed by the petitioner with her. It is further submitted that the victim refused to undergo medical examination, and as such, no such examination was conducted. Lastly, it is submitted that the petitioner, aged about 26 years, has been in custody since 23.07.2024 and has no criminal antecedents.
5. Learned Additional Public Prosecutor for the State has opposed the prayer.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let

No.52542 of 2025(2) dt.12-08-2025 3/3 the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge-cum- Special Judge POCSO, Supaul, in connection with Chhatapur P.S. Case No. 236 of 2024,.
