JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-03-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Parsauni P.S. Case No. 134 of 2014 registered for the offence under Sections-307, 302, 504 of the Indian Penal Code. Taking into consideration that there is allegation of assault against these petitioners, I am not inclined to extend the privilege of anticipatory bail to the petitioners and accordingly, prayer for anticipatory bail of the petitioners in connection with Parsauni P.S. Case No. 134 of 2014 pending in the court of Chief Judicial Magistrate, Sitamarhi/concerned court stands rejected. However, if, the petitioners surrender in the court

Patna High Court Cr.Misc. No.8552 of 2015 (2) dt.09-03-2015 2/2 below and seek regular bail, this order shall not cause any prejudice to the learned court below at the time of consideration of regular bail application of the petitioners.
