The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.
Prosecution case is of killing the daughter of the informant within two years of marriage. It is alleged that due to the torture inflicted for non-fulfillment of dowry demand, the victim consumed poison when she was taken to Biharsharif Hospital from where she was referred to Patna where she died and the dead body was disposed of hurriedly.
It is submitted by learned counsel for the petitioner that the petitioner died due to ailment and the dead body was disposed
Patna High Court Cr.Misc. No.14905 of 2016 (2) dt.08-04-2016 2/2 of in presence of the informant. Moreover, the informant has retracted from initial version and has filed a petition to that effect before the learned court below, the same has been brought on record as annexure-2 to the petition.
The aforesaid facts constitute ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Noorsarai P.S. Case No.290/2015, pending before the learned CJM, Nalanda. With the above observation, this application is, accordingly, disposed off.
