2. The petitioner is apprehending his arrest in connection with Dhankund P.S. Case No. 70 of 2025 dated 28.07.2025 registered for the offence punishable under Section/s 191(2), 190, 126(2), 115(2), 118(1), 76, 109(1), 352, 351(2) of the B.N.S., 2023.

3. The accusation against the petitioner is that he pulled the informant's hair and attempted to assault her on the head with an iron rod, causing injury to her left hand.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case. It is next submitted that the allegation against the accused persons is that besides other co-accused, the petitioner had also gone to the place of the Informant to stop construction

Patna High Court CR. MISC. No.51713 of 2026(2) dt.29-07-2026 2/3 work and during course of the same, the altercation took place and injuries are said to have been caused to the Informant. It is next submitted that there is nothing specific against the petitioner. It is further submitted that the injuries have been found to be simple in nature and all other co-accused persons have already been extended privilege of anticipatory bail by the District Court itself and because of non-disclosure of one criminal antecedent, the privilege has been denied to him. Counsel for the petitioner, on instruction, undertakes that the petitioner will not visit the work site to cause any disturbances, if privilege of anticipatory bail is extended to him. Lastly, it is submitted that the petitioner has one criminal antecedent in which he is on bail.

5. Learned APP for the State opposes the prayer for grant of anticipatory bail.

6. having heard learned counsel for the parties and considering the fact that the allegation against the petitioner is general and omnibus while the injuries have been found to be simple in nature and, as also, taking into account the undertaking given by the learned counsel for the petitioner, let the petitioner, above named, be released on anticipatory bail in the event of his arrest or surrender before the court below within a period of six weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the

Case No. 70 of 2025, subject to the condition as laid down under Section 482(2) of the B.N.S.S. as well as the following conditions: (i) One of the bailors should be the family member/relative/known of the petitioner who shall provide official document / personal affidavit to show his/her bona fide; (ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Ajit Kumar, J) rishi/- U T
