JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,149,341,323,324,379 and 504 of the Indian Penal Code. The prosecution case is that on 19.10.2015 at 9.30 A.M. all the accused persons including the petitioner entered into the courtyard of the informant and started painting the wall, on protest being made, co accused Shibu Yadav assaulted with fists and slaps while the petitioner caused injury with farsa on the head of the informant, co accused Raj Kumar and Dhanraj Yadav caused injury on the head of Virendra Yadav by means of iron rod. The informant has received five injuries but the injury on the head has been found to be grievous.
It is submitted by the learned counsel for the petitioner
Patna High Court Cr.Misc. No.16886 of 2016 (2) dt.21-04-2016 2/2 that there is counter version of the occurrence and in the background of land dispute the accusation has been levelled. The petitioner has also received grievous injury. The injury report is Annexure 4. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Madhubani in connection with Basopatti P.S. Case No. 139 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
