The petitioner seeks bail in anticipation of his arrest in connection with Majhaulia P.S. Case No. 381 of 2020, dated 02.06.2020, instituted for the offences under Sections 153(A), 295, 295(A) and 505(3) of the Indian Penal Code.

Patna High Court CR. MISC. No.9401 of 2021(2) dt.20-12-2021 2/3 The accusation against the petitioner is of having pierced one of statues inside a temple.

It has been submitted on behalf of the petitioner that from the reading of the F.I.R., it would appear that the informant, who is a police officer, was told by people, whose names have not been disclosed in the F.I.R., that the petitioner had entered the temple for committing sacrilege. It has further been submitted that nothing of the kind as reported in the F.I.R. has happened and the implication of the petitioner is based merely on suspicion.

The counsel for the petitioner denies every part of the allegation and submits that he has been falsely implicated in this case.

Regard being had to the nature of accusation against the petitioner and his being a person of clean antecedent, he, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of
