The petitioner apprehends his arrest in a case under Sections 364/366 and other sections of the Indian Penal Code. The informant made allegation that the petitioner and other accused persons forcibly kidnapped his minor daughter on 12.08.2014.

It is submitted that the occurrence is of 12.08.2014 but the F.I.R. is lodged on 21.08.2014. The victim is a major girl and she made her statement under Section 164 Cr.P.C. She disclosed that nobody had kidnapped her and she voluntarily went with Bikau Rai, the petitioner.

Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt

Patna High Court Cr.Misc. No.8442 of 2015 (2) dt.03-03-2015 2/2 / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Pupri at Sitamarhi in Nanpur P.S.
