The petitioner in the present case is seeking regular bail in connection with Barauni P.S. Case No.563 of 2018 registered for the offence punishable under Sections 302 and 386/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and all the allegations as alleged in the FIR are totally false and concocted and he has falsely been implicated in this case. He is in custody since 01.12.2018.

Learned APP has opposed the prayer for bail.

Considering the facts and circumstances of the case wherein the FIR itself states that in presence of the officer-in-

No.51889 of 2019(4) dt.20-11-2019 2/2 charge of the police station and the informant the deceased had made statement in injured condition in which he disclosed the name of this petitioner and the injuries are corroborated from the postmortem report as also that this petitioner has got four cases on his head and has got criminal antecedent, this Court is not inclined to grant regular bail to the petitioner.
