JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2018 Heard the learned counsel for the petitioner and State. The petitioner is in custody in connection with Rajpur P.S. Case No. 115 of 2018 for the offence under Sections 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Learned counsel submits that the petitioner is the driver and he was not aware of the fact that liquor was loaded in the truck, as the driver he has to deliver the goods loaded at the destination point. Learned counsel submits that the petitioner is in custody since 02.06.2018. In the instant case the petitioner was apprehended because he was driving the said vehicle.

Considering the fact that the petitioner has no criminal antecedent, the petitioner, named above, is directed to be

Patna High Court Cr.Misc. No.40621 of 2018(2) dt.10-07-2018 2/2 released on bail after 17.07.2018 on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge, Excise, Buxar, in connection with Rajpur P.S. Case No. 115 of 2018.
