JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-08-2019 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 3, 4, 5, 6 and 7 of the Immoral Traffic (Prevention Act), 1956.
The prosecution case, as per the written report of Rani Kumari, being the S.I., submitted to the Station House Officer, Chakand Police Station, is to the effect that S.S.P., Gaya received an information that in Hotel Bahurani, situated at Chakand, immoral trafficking is going on. Consequently, raid was laid in the said hotel in presence of the Hotel Manager in
Patna High Court CR. MISC. No.47915 of 2019(2) dt.01-08-2019 2/3 question and from two separate rooms, two couples who were in compromising position, were apprehended. The Manager of the hotel in question suggested the name of the petitioner as the owner of the hotel in question.
It is submitted by learned counsel for the petitioner that the petitioner was admittedly not present at the place of occurrence and merely on the basis of the statement of the Manager of the hotel in question, the name of the petitioner has been roped in the present case. A statement has been made in paragraph no.3 of the petitioner that apart from the present case, the petitioner is also made accused one other case, in which he is on bail. Learned APP submits that the petitioner is the owner of the hotel in question.
Considering the fact that the petitioner was not present at the place of occurrence and the thrust of accusation is against the apprehended couples and the manager of the hotel in question, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Gaya in
