JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-07-2018 The petitioner seeks bail in connection with K. Hat (Maranga) P.S. Case No. 33 of 2018 dated 18.01.2018 instituted for the offences under Sections 363, 307, 302, 201, 120(B) of the Indian Penal Code.

The brother of the deceased lodged the F.I.R initially that his brother Bholu Sarraf (deceased) had not returned home till late in the night. His mobile phone was also found to be switched off. As a result, a case was registered for the offences under Section 363 and 370 of the Indian Penal Code. Later, the father of the deceased raised suspicion on the friends of the deceased. In that connection, names of about five accused persons were taken by the father of the deceased. During the course of investigation, it came to light

Patna High Court Cr.Misc. No.40398 of 2018 (2) dt.11-07-2018 2/2 that there was a congregation of friends at the house of the petitioner. The petitioner actually had arranged for a small party at his place on the eve of Makar Sankranti. It was in that party that one Aman Singh fired at the deceased, killing him. The dispute between Aman Singh and the deceased was because of some money transaction in connection with sale and purchase of land. Similar statement has been made by aforesaid Aman Singh and other witnesses.

The petitioner is in custody since 06.02.2018. The other cases in which the petitioner has been made accused earlier, he is on bail.

Considering the aforestated facts, the petitioner above named, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with K. Hat (Maranga) P.S. Case No. 33 of 2018.
