The petitioner is in custody since 19.5.2018 in connection with Sarai P.S. Case No. 88 of 2018 registered for the offence punishable under Section 414, 120 (B) of the I.P.C and Section 30 (a), 35 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Petitioner was arrested in connection with seizure of huge quantity of liquor from the truck. Learned counsel for the petitioner submits that petitioner has no concern with the article contained in the truck. He was not caught from the said truck rather he was arrested from the road side when he was waiting for Auto on the road.

No.39089 of 2018(2) dt.09-07-2018 2/2 Considering the fact that petitioner has remained in custody in this case for more than 1 1⁄2 months, let the petitioner named above is directed to be released on bail after 19.7.2018 on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Additional Sessions Judge II-cum- Special Judge, Vaishali at Hajipur in connection with Sarai P.S. Case No. 88 of 2018.
