This is an application for grant of anticipatory bail in connection with Bihta PS case no. 842 of 2013 registered for the offences punishable under Sections 406, 420, 467, 468, 506/34 IPC.

The allegation is regarding the informant of this case having entered into a land deal for purchase of land from the petitioner herein via the land broker namely co-accused Bhola Singh and the informant is said to have given a sum of Rs. 16 lacs in total to the petitioner herein, however the petitioner did not execute the sale deed.

The learned counsel for the petitioner submits that the petitioner has got no connection with the informant of this

No.53106 of 2019(4) dt.27-11-2019 2/2 case and if at all, anyone is responsible for having mis-appropriated the amount of sale consideration, it is the land broker namely co-accused Bhola Singh. It is further submitted that the petitioner is having a clean antecedent and would definitely join investigation, if he is released on bail. Having regard to the facts and circumstances of the case, I deem it fit and appropriate to admit the petitioner to the privilege of anticipatory bail. Accordingly, the abovenamed petitioner, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. Danapur, Patna in connection with Bihta PS case no. 842 of 2013 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure. (Mohit Kumar Shah, J) rinkee/- U T
