Earlier prayer for bail of the petitioner was rejected vide order dated 6.11.2017 passed in Cr.Misc.No.40531 of 2017. It appears that the case is under Sections 394, 412 and 307 of I.P.C. Allegation against the petitioner and other accused persons is of assault to the informant with knife and on chase the petitioner was arrested and one bloodstained knife was recovered from the accused persons.

Submission of the petitioner is that he is in custody for more than fifteen months and up till now the trial has not commenced. No prosecution witness has been produced before the court below despite issuance of processes against the prosecution witness as well as letter to the S.S.P., Patna for production of prosecution witnesses. He has no criminal antecedent.

Patna High Court Cr.Misc. No.39517 of 2018 (2) dt.04-07-2018 2/2 Heard the learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned A.S.J.-V, Patna, in Session Trial No.550 of 2017 arising out of Parsa Bazar P.S. Case No. 36 of 2017.

With the aforesaid observation, this application is allowed.
