Learned counsel appearing on behalf of the petitioner would submits that the case of the petitioner is squarely covered by the judgment of this Court vide C.W.J.C. No. 11936 of 2011 (Bipin Bihari Roy versus State of Bihar & Ors) dated 01.03.2017 and L.P.A. No. 438 of 2017 (The State of Bihar & Ors versus

Patna High Court CWJC No.5664 of 2021(2) dt.25-03-2021 2/2 Prabhakar Mishra & Ors) dated 10.01.2018.

Considering the aforesaid submissions, the present writ application is disposed off with a direction to the respondents to scrutinize the fact and if it is found that the fact of this case is similar to that of C.W.J.C. No. 11936 of 2011 (Bipin Bihari Roy versus State of Bihar & Ors) dated 01.03.2017 and L.P.A. No. 438 of 2017(The State of Bihar & Ors versus Prabhakar Mishra & Ors) dated 10.01.2018, same treatment shall be extended to the petitioner by the respondents within a maximum period of three months from the date of receipt/production of a copy of this order.

With the aforesaid observation/direction, the writ petition stands disposed off.
