Arif (APP) ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 10-04-2015 The petitioner is facing allegation of impersonation and cheating punishable under Sections 419 and 420 of the Indian Penal Code. He is alleged to have made another person to appear in the examination in his place. Apprehending his arrest, the petitioner filed ABP No.18895 of 2014 before the Sessions Judge, Patna. The same was rejected on 06.06.2014. Hence, this application for grant of anticipatory bail under Section 438 Cr. P.C.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This Court is of the view that the petitioner need not be granted anticipatory bail. Instead, he can surrender before the trial Court itself and move an application for regular bail on

Patna High Court Cr.Misc. No.37412 of 2014 (2) dt.10-04-2015 2/2 the same day.

Hence, the application is dismissed, leaving it open to the petitioner to surrender before the learned Chief Judicial Magistrate, Patna in connection with Patliputra P.S. Case No.128 of 2012 and move an application for regular bail. If such an application is filed, the trial Court shall take up the same forthwith.
