The petitioners, namely, Ravi Singh and Geeta Devi, apprehend their arrest in a case under Sections 304(B) and other sections of the Indian Penal Code.
The father of the deceased made allegation that his daughter Kanchana Mishra was killed by her husband and other in-laws.
It is submitted that the petitioners are the father-inlaw and the mother-in-law of the deceased. The marriage was solemnized three years ago from the date of occurrence. No complaint was ever made about demand of dowry and torture. The deceased committed suicide as she was not able to give birth to a child. The doctor, who held post mortem, has opined that on
Patna High Court Cr.Misc. No.8391 of 2015 (2) dt.02-03-2015 2/2 account of hanging, the deceased died due to Asphyxia. Having considered the fact that the petitioners are the father-in-law and the mother-in-law of the deceased and there is no specific allegation of demand of dowry and torture against the petitioners and the husband of the deceased is in jail, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in Azamnagar P.S. Case No. 296/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
