The petitioner apprehends his arrest in Barun P.S. Case No. 97/2018, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 332, 333, 353, 395, 436, 504, 120B of the Indian Penal Code and sections 3, 4 of Prevention of Damage to Public Property Act.
The S.H.O. of Barun P.S. alleged that he got information about an accident and having received the information, the informant and other police officials went to the place of occurrence, but the injured succumbed to the injuries. It is alleged that the mob of 200 unknown persons and the accused persons named in the F.I.R., ran amok and ransacked the police station, they also put fire and damaged the public property.
Patna High Court Cr.Misc. No.39657 of 2018 (2) dt.10-07-2018 2/2 Learned counsel for the petitioner submits that petitioner was mere a spectator. Similarly situated other accused persons have been either granted anticipatory bail or regular bail. Considering the facts aforesaid and the fact that of course petitioner is named in the F.I.R., but no specific allegation is made against him, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 97/2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J) Vinita/- U T
