2. The petitioner apprehends arrest in connection with Jadopur P.S. Case No. 78 of 2022 dated 22.05.2022, instituted for the offence punishable under Sections 341, 323, 379, 307, 436, 504, 506/34 of the Indian Penal Code.

3. The prosecution case, in short, is that the petitioner along with other accused persons forcefully intervened in the premises of informant and started assaulting him due to which he got injury on his head. When the wife of the informant came to save him then she was also assaulted by accused persons.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that petitioner and informant are full brothers and due to quarrel both side lodged FIR against each

Patna High Court CR. MISC. No.53770 of 2024(2) dt.28-08-2024 2/2 other. It is further submitted that co-accused Krishna Prasad, who is also full brother of the informant, lodged Jadopur P.S. Case No. 79 of 2022 against the informant and his family members. It is next stated that there is a specific allegation against Krishna Prasad, who assaulted with lathi on the head of informant. There is no specific allegation against the petitioner rather the allegation is general and omnibus in nature. Lastly, it has been submitted that petitioner has no criminal antecedents.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Jadopur P.S. Case No. 78 of 2022, he/they shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Gopalganj subject to condition as laid down under Section 438(2) of the Cr.P.C.
