Case No.148 of 2013 registered for the offences punishable under Sections 420, 406, 120B read with 34 of the Indian Penal Code. Apprehending his arrest, the petitioner filed ABP No.712 of 2013 before the Sessions Judge, Siwan. The same was rejected on 13.08.2013. Hence, this application for grant of anticipatory bail under Section 438 Cr. P.C.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. It is represented that out of seven persons named as accused in the case, all others, except the petitioner, were granted anticipatory bail by this Court. This fact is not disputed by the learned Additional Public Prosecutor.

In the event of arrest, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Siwan Mufassil (Dhanauti OP) P.S. Case No.148 of 2013, subject to the conditions as laid down under Section 438(2) Cr. P.C.
