The petitioner apprehends his arrest in Bakhri P.S. Case No. 60/2018, registered for the offences punishable under Sections 147, 148, 149, 447, 323, 324, 386, 379 and 504 of the Indian Penal Code.

The informant alleged that nine persons including the petitioner came to the land where the informant was constructing his house and asked the informant not to construct the building, as the land belongs to their ancestor. It is alleged that the petitioner gave blow with the knife to the informant, but he did not sustain injury and the knife torned the shirt of the informant. It is further alleged that the accused persons demanded ransom and the informant gave Rs. 5,000/- to the petitioner.

Patna High Court Cr.Misc. No.39924 of 2018 (2) dt.10-07-2018 2/2 Learned counsel for the petitioner submits that entire allegation is false and concocted. No injury was caused to the informant. No ransom was paid by the informant. The informant wanted to grab the land of the petitioner and that is why this false case has been lodged. On perusal of the F.I.R. itself, it appears that there is land dispute between the two sides.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate V, Begusarai in connection with Bakhri P.S. Case No. 60/2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J) Vinita/- U T
