No.2027 of 2014) in which cognizance has been taken for the offences punishable under Section 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act. Apprehending his arrest, the petitioner filed ABP No.1321 of 2014 before the Sessions Judge, Rohtas, Sasaram. The same was rejected on 07.08.2014. Hence, this application for grant of anticipatory bail under Section 438 Cr. P.C.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The only allegation against the petitioner is one

Patna High Court Cr.Misc. No.39725 of 2014 (2) dt.10-04-2015 2/2 under Section 498A of the Indian Penal Code. In a case of this nature, it is not at all necessary that the accused must be arrested.

Therefore, the application is allowed. It is directed that in the event of arrest, the petitioner shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Magistrate, Rohtas at Sasaram in connection with Sasaram (Model) Complaint Case No.873 of 2013 (Tr. No.2027 of 2014).
