JUSTICE ARUN KUMAR ORAL ORDER 09-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 21.5.2018, seeks bail in Shahpur PS Case No. 44 of 2017 registered under Sections 341, 323, 324, 307 and 379/34 of the IPC.

The allegation in brief is that the petitioner went to the shop of the informant to purchase rope and on account of dispute in making payment it is alleged that he put the rope around neck of the informant and tried to strangulate and others also assaulted. Learned Counsel for the petitioner submits that due to dispute over payment quarrel followed and on account of that false allegation of making attempt of strangulation and taking out two lakh rupees cash has been made, however the injuries are simple in nature, the petitioner has been in custody since 21.5.2018 and has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Salandi Rai is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM lst, Danapur in connection with Shahpur PS Case No. 44 of 2017.
