JUSTICE JYOTI SARAN ORAL ORDER 12-05-2015 Heard Ram Kishore Singh, learned counsel appearing on behalf of the petitioner and learned counsel for the State.

The petitioner is a licensee under the Public Distribution System (Control) Order, 2001 as enforced in the State of Bihar vide Fair Price Shop Order, 2007 (hereinafter referred to as 'the Control Order') bearing Licence No.47 of 2007. The licence of the petitioner was cancelled vide order bearing Memo no.1020 dated 19.11.2011 passed by the Licensing Authority -cum- Sub-Divisional Officer, Sonepur, district Saran at Chapra on grounds of alleged irregularities and being aggrieved the petitioner has filed statutory appeal under

Patna High Court CWJC No.2804 of 2015 (2) dt.12-05-2015 Clause-15 of 'the Control Order' giving rise to Supply Appeal No.137 of 2011 which is stated to be pending before the appellate authority, i.e. the District Magistrate, Saran at Chapra for disposal. The limited prayer has been made by the petitioner in this writ petition to expedite the appeal. Having heard learned counsel for the parties and considering the limited grievance raised by the petitioner the writ petition is disposed of with a direction to the District Magistrate, Saran at Chapa to consider and dispose of the Supply Appeal No.137 of 2011 filed by the petitioner in accordance with law and after giving opportunity of hearing to the petitioner expeditiously and preferably within a period of three months from the date of receipt/production of a copy of this order.
