Mr.Uday Chand Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 08-08-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Birpur P.S. Case No. 70/2019, instituted for offence under Section(s) 399, 402 of the Indian Penal Code read with Sections 26 and 35 of Arms Act. It is alleged that police got information that 5-6 criminals have assembled at the Basha of Ganeshi Yadav in Sikarual field and planning to commit dacoity. On such information police party reached at the place of occurrence and saw six persons were sitting on a Chouki. One person was standing having arms in his hand. All the accused persons started running away on seeing the police. The petitioner was apprehended along with other accused persons as named in written report. In course of search, nothing has been recovered from possession of petitioner. It is alleged

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Begusarai, in connection with Birpur P.S. Case No. 70/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
