Petitioners are facing accusations punishable under Sections 147, 341, 323, 379, 506 of the IPC and Section 3(1)(x) of the SC/ST (Prevention of Atrocities) Act vide Srinagar Pujaha P.S. Case No. 82 of 2015.

On going through the F.I.R., it does appear that the allegations are not very serious, however, considering the bar created under the Act, this Court is not inclined to exercise its jurisdiction under Section 438 of the Code of Criminal Procedure leaving the petitioners to appear and seek bail in the Court below.
