JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-07-2018 Heard the learned counsel for the petitioner and State. The petitioner is in custody in connection with Case No. C2/269/18 for the offence under Sections 30(A) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Petitioner is in custody since 10.05.2018 in connection with seizure of 711 liter liquor of Nepali saufi wine. Learned counsel submits that nothing was recovered form the conscious possession of the petitioner, the petitioner is innocent and falsely been implicated in the present case on account of local enmity.

Considering the fact that the petitioner has remained in custody since 10.05.2018 and he has no criminal antecedent,

Patna High Court Cr.Misc. No.40491 of 2018(2) dt.11-07-2018 2/2 the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Sitamarhi, in connection with C2/269/18.
