JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-06-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Banka ( Barahat) Police Station Case No. 20 of 2015 registered for the offences punishable under Section 7 of the E.C.Act. One tractor loaded with 70 bags of wheat was intercepted by the informant and other police officials and after that the P.D.S shop of the petitioner was raided and 130 bags of wheat, 290 bags of rice were found in the stock of the petitioner. Para-8 of the petition reveals that only 12 bags of wheat was found short and 10 bags of Rice was excess in the stock of the petitioner. It is submitted that the aforesaid shortage and excess may be a defect in the counting of the stock.

No.10930 of 2015 (4) dt.25-06-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in Banka ( Barahat) Police Station Case No. 20 of 2015, subject to condition as laid down under Section 438(2) of the Cr.P.C.
