The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 324, 307, 379, 34 of the Indian Penal Code.

It is alleged that this petitioner along with other accused persons has stabbed the brother of the informant, as a result of which, he sustained grievous injuries.

It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in

Patna High Court CR. MISC. No.60787 of 2021(3) dt.28-06-2022 2/2 this case. The informant is not an eye witness. There is general and omnibus allegation against the petitioner. The learned A.P.P has vehemently opposed the prayer for anticipatory bail of the petitioner and submitted that the victim in para 38 of the case diary has given his statement and specifically stated that this petitioner caught hold the victim and Rakesh Mahto stabbed him. The independent witnesses have also corroborated the prosecution version.

Considering the aforestated facts, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

The prayer for anticipatory bail of the petitioner stands rejected.
