JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-03-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Jogbani P.S. Case No. 128 of 2014 registered for the offences punishable under Sections 273, 274 of the Indian Penal Code, Sections 18 (c) and 27 (b) (ii) of Drugs and Cosmetics Act. Although, it is submitted that seizure list does not bear the signatures of the petitioners and as a matter of fact, nothing was recovered from the house of the petitioners, but I am not, at all, convinced with the aforesaid submissions and taking note of this fact that in huge quantity intoxicated drugs were recovered from the house of the petitioners, I am not inclined to grant the privilege of anticipatory bail to the petitioners and
Patna High Court Cr.Misc. No.10755 of 2015 (2) dt.19-03-2015 accordingly, their prayer for anticipatory bail in connection with Jogbani P.S. Case No. 128 of 2014 pending in the court of Additional Chief Judicial Magistrate, Araria stands rejected. However, it is made clear that this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioners.
