JUSTICE RAVI RANJAN ORAL ORDER 28-07-2016 This case has been listed out of turn upon the motion of the petitioner. It is stated in the mentioning slip that the instant matter could not be taken up for hearing even once during the last six years. On such assertions having been made this case was directed to be listed within top ten cases. However, from perusal of record it appears that the fact is otherwise. The matter was taken up for hearing on 13.3.2015. On call, none appeared on behalf of the petitioner. Matter was adjourned. It was again taken up on 19.3.2015. Yet again none had appeared to press this application. The same was dismissed on the ground of nonprosecution.
Thereafter, the matter was restored vide order dated 2.9.2015 passed in M.J.C. No. 1789/2015 and after fixing a date the matter is called out today. Again none appears on behalf of the petitioner. However, learned counsel for the State is present.
Patna High Court CWJC No.6836 of 2008 (4) dt.28-07-2016 2/2 once in the last six years as the fact is that it was taken up but due to laches on the part of the petitioner it was dismissed for nonprosecution. In the aforesaid facts and circumstances this application is again dismissed for want of prosecution. (Dr. Ravi Ranjan, J) Spd/- U
