2. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 498A, 323/ 34 of the Indian Penal Code.

3. As per the prosecution case, this petitioner along with other accused persons tortured the complainant, assaulted her and also ousted her from her matrimonial house due to nonfulfillment of demand of dowry.

4. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. As a matter of fact complainant was in love affairs with Gaju Sahni and she has solemnized marriage

Patna High Court CR. MISC. No.55986 of 2023(2) dt.30-08-2023 2/2 with him and father of complainant has already filed Patahi PS case No. 167/ 2023 against said Gaju Sahni. In the aforesaid case the victim in her statement u/s 164 of the Cr.P.C. stated that she has solemnized marriage with Gaju Sahani and now she is living with him. Petitioner has got clean antecedent.

5. Learned counsel appearing for the State opposes the prayer for anticipatory bail.

6. Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Complaint case No. 998/ 2022, subject to conditions laid down u/s 438(2) of the Cr. P. C.
