2. The petitioner seeks regular bail in connection with Saharsa Sadar P.S. Case No. 246 of 2024 registered for the offence under Sections 302/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and two other co-accused took away the deceased and thereafter on the subsequent morning, the dead body of the deceased was recovered.

4. Learned counsel for the petitioner submits that petitioner has been named in this case due to land dispute and suspicion. The petitioner is in custody since 18.03.2024.

5. Learned A.P.P. has vehemently opposed the prayer

Patna High Court CR. MISC. No.53455 of 2024(3) dt.25-09-2024 2/2 for bail and has submitted that witnesses have seen the petitioner and other co-accused persons taking away the deceased and thereafter, the dead body of the deceased has been found.

6. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. This application for regular bail is rejected.
