JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-04-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 406,420,467,468 and 471/34 of the Indian Penal Code. The prosecution case is that petitioner no. 1 Mumtaz Ahmad Khan approached the informant for getting his daughter namely Jyoti admitted in medical course. The petitioner Mumtaz Ahmad Khan got the informant introduced with Vikas Kmar Verma and Gyan Prakash Sinha when eight lacs ninteen thousand rupees were given to Gyan Prakash Sinha but the daughter of the informant was not admitted in medical course. Subsequently, two

Patna High Court Cr.Misc. No.18213 of 2016 (2) dt.27-04-2016 2/2 cheques of rupees three lacs fifty thousand and rupees three lacs twenty five thousand respectively were given which got bounced. It is submitted by the learned counsel for the petitioners that the thrust of accusation is against co accused Gyan Prakash Sinha. Admittedly, the cheques were not issued by the petitioners. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Begusarai, in connection with Mufassil (Singhaul O.P.) P.S. Case No.104 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
