====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-08-2023 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 504, 447, 384, 506, 308/34 of the Indian Penal Code.

3. It is alleged that on 12.02.2023 at about 11:00 AM, this petitioner along with other accused persons forcibly started constructing toilet on the land of the informant. On protest, all the accused persons assaulted the informant with bamboo and demanded extortion of Rs. 50,000/-.

4. It is submitted that due to petty dispute scuffle took place between the parties. The toilet in question was being constructed under the Scheme of Gram Panchayat and for which present Mukhiya of the Gram Panchayat has also lodged F.I.R.

Patna High Court CR. MISC. No.55551 of 2023(2) dt.28-08-2023 2/2 bearing SC/ST P. S. Case No. 04 of 2023 against the informant and others. Injuries sustained by the injured are simple in nature.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Alauli P. S. Case No. 55 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
