Petitioner, already in custody, seeks bail in connection with Chiraiya P.S. Case No.172 of 2015, giving rise to Trial No.1939 of 2017 registered under Sections 395 and 397 of the Indian Penal Code as well as under Section 27 of the Arms Act. Allegation in brief is that some unknown miscreants committed dacoity in the house of the informant and after looting them escaped away.

Learned counsel for the petitioner submits that nothing has been recovered from possession of the petitioner nor was put on TIP, the only material against him is the disclosure of his name in the confessional statement of Harendra Sahni, co-accused, moreover the petitioner has no criminal

Having considered the aforesaid facts and circumstances, petitioner Hira Lal Mahto @ Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Sikrahna at Dhaka, East Champaran, Motihari in connection with Chiraiya P.S.
