JUSTICE ANIL KUMAR SINHA ORAL ORDER 31-07-2019 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State. Petitioners apprehend their arrest in connection with Alauli P.S. Case No.67 of 2017, corresponding G.R. No.686 of 2017, for the offence punishable under Sections 341, 323, 307, 504, 506, 34 of the Indian Penal Code.

Patna High Court CR. MISC. No.47420 of 2019(2) dt.31-07-2019 2/3 The allegation against the petitioners is that the petitioners assaulted informant and her family member due to land dispute. It has further been alleged that Janardan Yadav assaulted the informant with Katta which hit near the hand of the informant.

Learned counsel for the petitioners submits that both the parties are agnates and there is admitted land dispute between them. He further submits that title suit between the parties is pending, as would be evident from the First Information Report itself. He further submits that the allegation of assault is on petitioner No.3, Janardan Yadav, and that too not on the vital part of the body of the informant and he further submits that no injury has been caused to anybody, as would be evident from the impugned order itself.

After having heard learned counsel for the petitioners as well as learned counsel appearing on behalf of the State and taking into consideration the fact that the parties are agnates and there is admitted land dispute between them and no serious injury has been found on record, as such, I am inclined to grant anticipatory bail to all these petitioners.

Accordingly, all the petitioners, above named, are directed to surrender before the learned Court below within a

No.47420 of 2019(2) dt.31-07-2019 3/3 period of four weeks from today and in the event of surrender by them, they shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Ankita Jaiswal, Judicial Magistrate, Ist Class, Khagaria, subject to the condition as mentioned under Section 438 (2) of Cr.P.C.
