1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 318(4), 338, 336(3), 340(2) and 61(2) of the BNS.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a woman and the informant alleges that petitioner and the Junior Engineer based on fake signature of the Headmaster of the concerned school on the bill related to submersible boring, bench and desk etc. obtained payment.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case without holding a proper inquiry. It is further submitted that had petitioner been given an opportunity of hearing to explain her

It is next submitted that petitioner is a registered contractor of the Road Construction Department, Government of Bihar and a tender notice was published inviting the contractor to dig submersible boring in the school. The petitioner in pursuance of the tender qualified and contacted the Headmaster of the Primary School, Chandan Bakhari, Mushahari and was given the work order. The petitioner completed the work and requested the Headmaster to submit the bill as per departmental order. It is also submitted that it was the Headmaster who submitted the bill but in the FIR it is being alleged that it was petitioner who submitted that bill faking the signature of the Headmaster.

It is submitted that petitioner is a registered contractor of the Road Construction Department, Government of Bihar and she is aware of the consequences which would entail in the event if it is found that petitioner indulged in such activity. It is submitted that petitioner will not abscond rather will cooperate in the investigation to prove her innocence.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned

No.54552 of 2025(2) dt.25-08-2025 3/3 counsel for the petitioner, let the petitioner above-named, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Mithanpura P.S. Case No. 64 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.
