2. The petitioner seeks bail in connection with Nawadah Town P.S. Case No. 64/2025, registered for the offence under Sections 126, 115(2), 117(2), 109(1), 67, 351(2), 352, 83 and 89 and Section 3(5) of BNS.
3. The accused/petitioner is named in the F.I.R. and is in custody since 13.02.2025.
4. As per FIR, the petitioner developed love with the informant and also performed marriage, while she was staying alone with her two children in a rented house separating from her husband. It is alleged that petitioner alongwith his family members assaulted the informant and further treated her with cruel behaviour.
5. Learned Counsel appearing on behalf of the petitioner
Patna High Court CR. MISC. No.51603 of 2025(4) dt.26-09-2025 2/3 submitted that the allegation of physical assault is not available against this petitioner. It is submitted that the informant is a lady of questionable character and she had earlier also filed a case against one Ramnath and others under Section 376 of the IPC, which was registered as Mahila P.S. Case No. 17 of 2020. It is submitted that marriage of the informant was still subsisting and as this petitioner helped her on different occasions, she forced petitioner to solemnize marriage but it was not possible for the reason that petitioner was also a married person. It is pointed out that the allegation which available against this petitioner is that he was living with Juli Kumari, who was none but the wife of this petitioner. While concluding the argument, it is submitted that investigation of this case is already completed, for which chargesheet has been submitted, as such, there is no chance of tampering with the evidence and, moreover, petitioner found involved in three more criminal cases, where he is on bail
6. Learned APP opposed the prayer of bail.

Considering the aforesaid factual submissions and by taking note of overall nature of accusation, where the informant claimed her marriage with the petitioner while subsisting her earlier marriage, coupled with the fact that investigation of this case is already completed, where petitioner remains in custody
Patna High Court CR. MISC. No.51603 of 2025(4) dt.26-09-2025 3/3 since 13.02.2025, accordingly, petitioner above named, is directed to be released on bail in connection with Nawadah Town P.S. Case No. 64/2025, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawadah/concerned Court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C./Section 480(3) of BNSS.
