JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2018 Heard the learned counsel for the petitioner and State. The petitioner is in custody in connection with Samastipur Rail P.S. Case No. 73 of 2018 for the offence under Section 30(A) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent, only on suspicion he has been apprehended in this case. Learned counsel submits that petitioner is a student of Intermediate, 2018, he was arrested by returning back from Calcutta in Gangasagar Express, he was apprehended by the police on suspicion that the liquor seized belongs to this petitioner, petitioner is in custody since 16.05.2018.
Considering the fact that the petitioner, named above,
Patna High Court Cr.Misc. No.40445 of 2018(2) dt.10-07-2018 2/2 is directed to be released on bail on the condition that the bailers would be the teacher of the school on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge-cum-Special Judge, Excise Act, Samastipur, in connection with Samastipur Rail P.S.
