The petitioner who is apprehending arrest has renewed her prayer for bail in a case registered for the offences punishable under Sections 304B, 201 and 120 of the Indian Penal Code.
Prosecution case is of killing the daughter of the informant after two years of marriage for non-fulfillment of dowry demand.
It is submitted by learned counsel for the petitioner that the thrust of accusation is against the husband of the informant, who is in custody and the victim died due to catching of accidental fire while preparing food and she was provided medical assistance but she succumbed to the injuries.
Patna High Court Cr.Misc. No.18847 of 2016 (2) dt.03-05-2016 2/2 Since, earlier the prayer for anticipatory bail of the petitioner was permitted to be withdrawn vide Criminal Miscellaneous No.21258/2015 by a co-ordinate Bench of this Court (now retired), this Court is not inclined to enlarge the petitioner on anticipatory bail.
Let the learned Court below consider the prayer for regular bail of the petitioner keeping in view of the fact that the petitioner being a lady, if she surrenders within a period of six weeks in connection with Arwal P.S. Case No.272/2014, pending before the learned CJM, Jehanabad.
With the above observation, this application is, accordingly, disposed off.
