The petitioner apprehends his arrest in connection with L.N.M.U. P.S. Case No. 99 of 2014 registered for the offences punishable under Sections 135 and 136 of the Electricity Act.

Learned counsel for the petitioner submits that the alleged offence had taken place in absence of the petitioner and without any notice to him. It is further submitted that even the seizure list indicates that apart from the official witnesses, there are no other independent witnesses of the area to support the prosecution case.

Patna High Court Cr.Misc. No.43231 of 2014 (2) dt.16-04-2015 Considering the aforesaid submissions and the nature of allegation, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga in connection with L.N.M.U., P.S. Case No. 99 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.. '
