JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-03-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147,148,149,341,323,324,307 and 504 of the Indian Penal Code and section 27 of the Arms Act.
The specific accusation of assault is against co accused Binno Yadav, Inno Yadav, Jajjan Yadav, Happo Yadav along with petitioner no. 3 Pankaj Yadav.
It is submitted by learned counsel for the petitioners that specific accusation of assault is not against the petitioners except petitioner no. 3 and the accusation has been levelled in the
Patna High Court Cr.Misc. No.10939 of 2015 (2) dt.17-03-2015 2/2 background of land dispute.
Let the learned court below consider the prayer for regular bail of the petitioner no. 3 in case the petitioner no. 3 surrenders within six weeks from today in connection with Jagdishpur P.S. Case No. 219 of 2014 pending in the court of learned C.J.M., Bhagalpur.
So far as petitioner nos. 1,2,4,5 and 6 above named are concerned, let them be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur in connection with Jagdishpur P.S. Case No. 219 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
