JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2018 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Bakhtiyarpur P.S. Case No. 218 of 2018 for the offence registered under Sections 37(c), of Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner was apprehended by the police in intoxicant condition, except for the allegation of consumption of liquor there is no other allegation against the petitioner and the petitioner is in custody since 31.05.2018.
Considering the fact that the petitioner has got no criminal antecedent and the allegation against the petitioner for consumption of liquor and he has remained in custody for more than one and half months, let the petitioner, named above is
Patna High Court Cr.Misc. No.40929 of 2018(2) dt.10-07-2018 2/2 directed to be released on bail on furnishing bail bond of Rs.10000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Saharsa in connection with Special (Excise) Case No. 308 of 2018 arsing out of Bakhtiyarpur P.S.
