Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Complaint Case No. 89C of 2020, registered for the offences punishable under Sections 323, 324, 325, 307, 370(1), 498(A) and 511/34 of the Indian Penal Code and Sections 3⁄4 of the Domestic Violence Act.
Patna High Court CR. MISC. No.51516 of 2022(2) dt.19-01-2023 2/3 As per allegation, the accused persons, including the petitioner, who is husband, tortured his wife. The petitioner had ousted her from matrimonial house.
The impugned order shows that the process of conciliation taken place for one time settlement of the dispute as the matter was irretrievable, but the effort could not be successful.
The learned counsel for the petitioner has submitted that petitioner is ready to make a payment of Rs. 3,000/- per month to the complainant as maintenance.
Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Khagaria in connection with Complaint Case No. 89C of 2020, subject to condition as laid down under section 438(2) Cr. P.C. The petitioner is directed to make a payment of Rs. 3,000/- per month in the account of the complainant till 10th day of each month.
