2. The petitioner is in custody in connection with Pauthu P.S. Case No. 63 of 2025 for the offence punishable under sections 80, 85, 3(5) of BNS lodged on 08.05.2025 by the informant, Sanjay Kumar.
3. As per the prosecution story, the informant alleged that the daughter had tied nuptial knots after affair with Rakesh Kumar but later, she was tortured for dowry and ultimately, got the information that his daughter has been hanged. This led to the FIR.
4. Learned counsel for the petitioner submits that the petitioner is the mother-in-law, living separately, having no role
Patna High Court CR. MISC. No.51965 of 2025(2) dt.12-08-2025 2/3 to play in the matter, cause of death is asphyxia due to hanging, has no criminal antecedent and is in custody since 09.05.2025.
5. Learned APP as also learned counsel for the informant opposes the prayer for bail submitting that allegation is there against the petitioner.
6. Taking into account the aforesaid facts as also the averment made that she is living separately and was arrested immediately after the occurrence, has no criminal antecedent, in that background, this Court is inclined to extend her the privilege of bail with conditions.
7. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned ACJM-I, Aurangabad in connection with Pauthu P.S. Case No. 63 of 2025 subject to the following conditions:
(i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of her bail bond by the Trial Court itself;
Patna High Court CR. MISC. No.51965 of 2025(2) dt.12-08-2025 3/3 (iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of her bail bonds. (Rajiv Roy, J) Adnan/- U T
