The petitioner apprehends his arrest in K. Nagar P.S. Case no. 563/2014, registered for the offences punishable under Sections 406, 420 of the Indian Penal Code.
North Bihar Power Distribution Company Limited gave franchisee to the petitioner to collect money from the consumers. According to the statements of the Company, the petitioner collected Rs. 7,64,466/- but deposited only Rs. 2,38,243/-. According to the petitioner he collected only Rs. 5,51,796/- out of which he has already deposited Rs. 2,38,243/-. Learned counsel for the North Bihar Power Company submitted that counting is based on the receipt submitted by the
Patna High Court Cr.Misc. No.13665 of 2015 (3) dt.15-05-2015 2/2 petitioner.
Learned counsel for the petitioner also submits that the petitioner is ready to deposit the entire amount within four months. Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Shakchi Mishra, Judicial Magistrate 1st Class, Purnea in connection with K. Nagar P.S. Case No. 563/2014, G.R. no. 5228/2014, subject to the condition that the petitioner shall deposit half of the dues amount within two months from the date of his release and thereafter the petitioner shall deposit the remaining amount of dues after two months. If the petitioner fails to deposit the amount learned court below shall cancel the bail bond of the petitioner.
