JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419, 420 of the Indian Penal Code.
The prosecution case is that the petitioner took Rs. 9 lacs from the informant for getting the son and son-in-law of the informant employed in, Sabour Agriculture College. It is submitted by the learned counsel for the petitioner that earlier the informant took jewellery from the jewellery shop of the petitioner worth Rs. 9 lacs and part cost of jewellery in cash and through banking channel but balance amount was not paid, hence, the petitioner filed complaint case No. 1152(c) of 2015 on 30.11.2015 whereas the present FIR has been registered on
Patna High Court Cr.Misc. No.19757 of 2016 (2) dt.04-05-2016 2/2 12.02.2016. Statement has been in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Banka in connection with Shambhuganj P.S. Case No. 12 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
