JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 25-08-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 409, 420 and 120B/34 of the Indian Penal Code and Section 7 of the Prevention of Corruption Act, 2018.

Allegation against the petitioner is that he took bribe of Rs.5,000/- from newly elected Sub-Inspector during medical check up.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that there is no recovery from him as well as there is no consistent material to prove that he has taken bribe. Petitioner has clean antecedent.

Patna High Court CR. MISC. No.61243 of 2021(9) dt.25-08-2022 2/2 Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge Vigilance (TRAP) Act, Bhagalpur in connection with Begusarai Town P.S. Case No. 465 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
