The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 379, 504/34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act.
The prosecution case is that the daughter of the informant got married with co-accused Ajit Dhar four years prior to the lodging of the case. After the marriage the husband of the daughter of the informant went to Kolkata to earn livelihood when the father of the husband Bhulu Dhar further
Patna High Court Cr.Misc. No.17547 of 2016 (2) dt.26-04-2016 2/3 demanded one motorcycle as a dowry and when the daughter of the informant shown inability to fulfill the demand then he tried to establish illicit relation. It is alleged that the petitioners being the relatives of the husband of the daughter of the informant confined the daughter and wife of the informant in a room. It is alleged that petitioner no. 1 and petitioner no. 2 Vishal Singh snatched rupees eight thousand and mobile and from the wife and daughter of the informant petitioner no. 1 and co-accused Ajit Dhar snatched gold chain and earring.
It is submitted by learned counsel for the petitioners that the petitioners are not related to the husband of the daughter of the informant rather they are co-villagers but since they tried to pacify the matter they have been roped in the present case.
Considering the fact that the petitioners are not the relatives of the husband of the daughter of the informant, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Chamaparan, Motihari in connection with
